Kyuss Lives! have fired back a response to the lawsuit filed by former Kyuss band member Josh Homme over the use of the Kyuss name. Kyuss Lives!, which features original Kyuss members John Garcia, Nick Oliveri and Brant Bjork along with guitarist Bruno Fevery issued the following statement:
"We are both shocked and saddened that our friend and one time band mate has chosen to file a lawsuit against us, especially after having positive discussions since our reformation," said John Garcia and Brant Bjork. "We look forward to resolving this private matter behind closed doors and moving forward with work on our new album and connecting with our amazing, loyal fans."
The statement included this background: In 2010, Garcia, Bjork and Oliveri reunited alongside Belgium guitarist Fevery and returned to the stage for the first time in over 15 years as KYUSS LIVES!.
The group's 2011 world tour proved to be a feast of recognition for the legendary musicians and saw the band thrill audiences across the globe. The band's North American live return was called "a declaration of triumphant return" by the National Post while the group themselves were aptly described as "Influential" by Time Out New York, "the lords of stoner rock" by the Washington Post-Express and "pioneers of the genre" by The Charlotte Observer.
