Eminem Beats The Rap in Bully Defamation Suit

Eminem beat the rap in a defamation suit brought
against him by his childhood bully DeAngelo Bailey. On Friday Macomb County
Circuit Court Judge Deborah Servitto dismissed a $1 million defamation
lawsuit brought against the rapper by Bailey who sued Eminem in December
2001 claiming lyrics in the rappers Brain Damage slandered him and invaded
his privacy.
Eminem called out his childhood tormentor
by name in the rap, "I was harassed daily by this fat kid named DeAngelo
Bailey / An eighth grader who acted obnoxious 'cause his father boxes/
So every day he'd shove me in the lockers/ One day he came in the bathroom
while I was p---in'/ And had me in the position and beat me into submission."
The Judge ruled the lyrics were not defamatory
because they were written in the context of the song and not taken as literal
fact. She also added a rap of her own to the end of the judgment. According
to MTV, Servitto added the following footnote to her judgment; "Mr. Bailey
complains that his rep is trash/ So he's seeking compensation in the form
of cash / Bailey thinks he's entitled to some monetary gain/ Because Eminem
used his name in vain/ The lyrics are stories no one would take as fact/
They're an exaggeration of a childish act/ It is therefore this court's
ultimate position/ That Eminem is entitled to summary disposition."
