TMZ reports: Gene Simmons' legal team has
taken an ingenious first step in shutting down a website featuring a video
that shows Gene in a sex act with a woman who is not his longtime girlfriend,
Shannon Tweed.
We're told Gene's lawyers contacted Webmastercentral.com,
which is responsible for the content on the website promoting the video
-- ordering them to cease and desist because of copyright infringement.
How, you ask, is this copyright infringement? Gene's lawyers claim the
site had no right to use face paint to promote the skin flick, because
face paint is a KISS thing.
And now we're being told, the tape is old
and the copyright owner is ... drum roll ... Gene Simmons! Apparently,
Gene got wind of the tape a few years back and bought the rights. Who's
the apprentice now? BTW, the tape was shot without Simmons' permission
or knowledge -- and may well be illegal. That's why TMZ hasn't run it.-

Metal Underground reports: On Saturday night,
February 16th, BURY YOUR DEAD guitarist Eric Ellis was a victim of a random
attack by six individuals following the band's set at The Rave in Milwaukee,
Wisconsin. Eric was held at gunpoint while the men hit him multiple times
with a baseball bat and hammer.
Previous reports of a robbery are false,
as the Milwaukee police department has classified it as a 'gang initiation.'
Despite suffering what others would consider
serious injuries, Eric and the rest of BURY YOUR DEAD will move forward
and continue with their tour alongside HELLYEAH and take that into their
headlining run with EMMURE, THE WARRIORS, and WITH BLOOD COMES CLEANSING.
Added the band: "It will take more than
this to stop BURY YOUR DEAD. We'll see you soon."- more

Newswatch50 reports: Amy Winehouse's jailed
husband Blake Fielder-Civil was rushed to the prison medical block this
week after allegedly overdosing on drugs.
Fielder-Civil, who is currently behind
bars in London's Pentonville Prison, was found vomiting violently and writhing
in pain on the floor of his cell after reportedly taking a potentially
lethal combination of heroin mixed with an unknown toxic substance with
five other inmates.
A Prison Service spokesperson said, "A
small number of prisoners were treated in health care following the consumption
of an unknown substance."- more

TMZ reports: Puff Diddy Daddy is claiming
that the man who sued him over a fight outside of the Roosevelt Hotel in
Hollywood is at fault -- and the explanation is the oldest one in the book.
TMZ has obtained a declaration by Combs
filed in Los Angeles County Superior Court, explaining the incident (in
Diddy's classic words), alleging that Gerald Rechnitzer "continued moving
toward me and, without warning, lunged at me. Instinctively, I outstretched
one of my hands, which hand was not closed-fisted, to shield myself
"... any contact between Mr.Rechnitzer
and myself was caused by his forward motion against my stationary open
hand." - Diddy'll

Contact Music reports: LATEST: SIR PAUL MCCARTNEY
has disappointed pal OZZY OSBOURNE by declining an opportunity to duet
with the rocker at the 2008 Brit Awards.
The former Black Sabbath singer - who will
co-host the ceremony with his wife/manager Sharon - was ecstatic at the
prospect of fulfilling his lifelong dream of sharing the stage with the
former Beatle.
But McCartney, 65, has since decided to
perform a simple solo set instead. He says, "You can either go for something
wow or just do a couple of hits - I've opted for the latter. "I'm quite
happy to be just doing stuff that I hope the audience will like."-

antiMusic reports: We do realize that the
words "Idol" and "integrity" should never appear in the same sentence,
but this is a fun story about the anger from some people that actually
take the karaoke contest serious. Also of note, MCA Records used to be
jokingly called Music Cemetery of America for their large number of "flops".
e.g. a promising artist signs to the label and is never heard from again.
Now here is the Reuters story: The integrity of "American Idol" as a contest
for raw, undiscovered talent was called into question again after an Irish
singer who once had a major-label deal, and solo album that flopped, advanced
to the top rung of the competition this week.
Dublin native Carly Smithson, who formerly
recorded for MCA Records under her maiden name, Carly Hennessy, was one
of the 24 "Idol" contestants who made it on Wednesday to the semifinal
rounds voted on each week by the show's home TV audience.
Online critics immediately seized on her
initial success, and her professional recording background, as further
evidence that "the fix" might be in for the top-rated show on U.S. television.

Gigwise reports: Prince and the Village People
are to sue representatives of a Swedish download site after it emerged
that their songs were available for users to download without consent.
They claim that the owners of Pirate Bay,
which is already facing legal action from a British law firm, had not been
granted permission to use their music.
Lawyer Lars Sandberg, who has been hired
on behalf of the musicians, said it had not yet been decided whom the legal
action would be directed against.- more

Idolator reports: George Daniels, husband
of recently dismissed R. Kelly publicist Regina Daniels and longtime Chicago
music scene fixture, is attempting to shame a clearly unshamable man, raising
a stink that Kelly "crossed a line," this one moral, when he engaged in
an affair with the Daniels' daughter.
Turns out those "ROCK SOLID" rumors about
the relationship from November were actually true, except for the part
about Daniels' daughter being 19, as the alleged affair occurred after
Maxine Daniels was old enough to buy her own wine coolers.
Jeez, the R.'s publicists should know better
than anyone that the man only starts sweating if his transgressions involve
possible jail time.- more

AP reports: Survivors and relatives of the
100 people killed in one of the nation's deadliest nightclub fires marked
the fifth anniversary of the disaster yesterday with a somber service at
the fire site, where they received a first look at design plans for a proposed
permanent memorial.
Hundreds of people huddled next to the
makeshift memorial of crosses and photographs assembled on the grounds
of The Station nightclub, with some crying softly as the names of each
victim was slowly read aloud.
The Feb. 20, 2003, fire at The Station
nightclub in West Warwick began when the tour manager for the 1980s rock
band GREAT WHITE set off pyrotechnics at the start of a concert. The fire
left 100 people dead and more than 200 injured.- more

Idolator reports: Billy Joel's July concert
at Shea Stadium--the final musical event at the crumbling concrete behemoth--sold
out in one hour on Saturday morning, although the ticketing system used
to handle the show's ticket sales was apparently experiencing massive gridlock.
(Shea's overlords eschewed Ticketmaster
for in-house site 507tixx.com, which is named after the Mets' ticketing
hotline.)
As you might expect, the "secondary market"
for these tickets is thriving, despite the tech snafus and speedy sellout;
at present, there are 441 listings for tickets on the semi-legitimate scalping
site StubHub, with the highest single-seat price $99,215.-

south on Interstate 75 on Saturday night when its driver noticed a man
weaving in and out of traffic. Police in suburban Detroit later arrested
a 36-year-old man from Burton, Mich.

about 80 kilometres northwest of Detroit in connection with a carjacking
at a gas station.- more
