(TMZ) TMZ has learned that a sex tape featuring Usher and his ex-wife, Tameka Foster, is being hawked around town

TMZ was approached several days ago by someone claiming to have the sex tape. The person sent us a short video and two photos. We'll keep this PG-13 and just say ... the people in the video are both givers.

The video and photos are clear -- it's Usher and Tameka. Sources close to Usher -- without specifically admitting the existence of a sex tape -- tell us they believe this video could have been among the things Usher had stolen out of his car back in December 2009. more on this story

Surprise Kanye West Show

Idolator reports that Kanye West will be taking the stage at South By Southwest on March 19 at midnight at the VEVO Power Station.

The news came via a new video montage of Kanye's videos, various appearances and interviews.

This isn't the first time Yeezy has headed to Austin for the music fest — in 2009, West performed at the Fader Fort venue alongside special guests Consequence, Mr. Hudson and Big Sean. more on this story

Mel Gibson Plea Deal

TMZ had this report on Friday: Mel Gibson will be charged this morning with simple misdemeanor battery .... not felony domestic violence ... sources connected with the D.A. tell TMZ.

TMZ broke the story ... Mel has cut a deal, in which he will plead no contest to the misdemeanor battery charge.

The D.A. had the option of filing a more serious charge -- felony domestic violence, but the D.A. is filing the lesser charge which is the basis of the plea bargain. more on this story

Lindsay Lohan Gives Up One Vice

(TMZ) Lindsay Lohan has quit smoking -- a great move for her health ... whether there's a jail sentence for probation violation on her horizon ... or not (as she continues to believe).

Sources close to Lindsay tell TMZ she's continuing on the path to a healthier life by kicking her nicotine habit ... cold turkey no less.

Gallagher Released From The Hospital

(TMZ) Good news for Gallagher fans -- he's out of the hospital, three days after he collapsed on stage during a show ... TMZ has learned.

As TMZ first reported, the legendary comedian collapsed in Rochester, MN right in the middle of his act.

His manager tells TMZ he has left the hospital and even though he canceled a few tour dates, Gallagher will be resuming his tour on March 19 in The Woodlands, TX. more on this story

Mel Gibson Threatens To Sue Oksana?

(TMZ) Mel Gibson will [reportedly] sue Oksana Grigorieva for extortion if she dares sue him ... this according to sources close to Gibson.

As TMZ first reported, Oksana still plans to file a lawsuit against Mel, alleging battery, emotional distress and defamation.

But sources close to Gibson tell us he will wage legal war if Oksana files -- and will NOT settle out of court. In fact, we're told Mel will gladly file his own lawsuit against the woman he says put a $15 million price tag on the tapes in return for keeping them secret. more on this story
